KONZA TERMS OF USE

These Terms of Use govern access to and use of the KONZA service.

In these Terms, the words “KONZA”, “Service”, “we”, “us” or “our” mean individual entrepreneur Abelchakov Illia Leonidovych and the KONZA software service.

1. Acceptance of the Terms

The user accepts these Terms when they:

  • create an account;
  • sign in through Google Login;
  • use any KONZA feature;
  • connect a social network;
  • order a paid feature or plan;
  • submit content for generation or publication;
  • click the button accepting the Terms;
  • otherwise actually use the Service.

If the user does not agree with these Terms, they must not use KONZA.

If a person uses KONZA on behalf of a company, client, employer, brand or other party, they confirm that they have sufficient authority to accept these Terms on that party’s behalf.

2. Age of the user

KONZA is intended for users who are at least 18 years old.

By creating an account, the user confirms that they are at least 18 years old.

KONZA may restrict or terminate access if it has reasonable grounds to believe that the user is below the required age.

3. Description of the Service

KONZA is an AI/SaaS service for working with content.

Depending on the current functionality, the Service may:

  • create texts and drafts;
  • edit, rewrite, shorten or expand materials;
  • adapt content to a style, audience, brand or platform;
  • create headlines, descriptions, structures, ideas and content plans;
  • analyse information provided by the user;
  • work with news, links and third-party sources;
  • check materials for repetitiveness, compliance with instructions or other criteria;
  • create content for LinkedIn, Instagram, Threads and other platforms;
  • connect to social networks through their APIs;
  • create drafts for manual publication;
  • publish content through connected social networks;
  • provide other related tools for automating content work.

The specific set of features may change.

A description of a particular feature on the website does not mean that this feature will be available indefinitely or in every plan.

4. Nature of the AI service

KONZA uses artificial intelligence and third-party AI models, in particular:

  • OpenAI;
  • Anthropic.

The Service creates drafts, variants, recommendations, structures and other supporting materials.

The output of artificial intelligence is not guaranteed to be accurate, correct, unique, original, complete or fit for publication without review.

AI-generated content may:

  • contain factual errors;
  • contain invented facts;
  • convey context incorrectly;
  • contain outdated information;
  • contain inaccurate dates, names, figures or quotes;
  • resemble materials of other users;
  • resemble previously published materials;
  • fail to comply with the rules of a social network;
  • contain potential infringements of third-party rights;
  • require legal, editorial or professional review.

KONZA does not guarantee that automated checks will detect every error, violation, repetition or risk.

5. Obligation to review content

The user must review content before using or publishing it.

In particular, the user independently verifies:

  • facts;
  • dates;
  • names;
  • job titles;
  • figures;
  • statistics;
  • quotes;
  • sources;
  • links;
  • the correctness of conclusions;
  • compliance of the content with the law;
  • compliance with the rules of the social network;
  • copyright;
  • trademarks;
  • rights to name and image;
  • privacy rights;
  • advertising requirements;
  • the need to disclose the use of AI.

The decision to publish is always made by the user.

If the user configures automatic publication, they understand that content may be published without additional manual confirmation, in accordance with the settings they have chosen.

The user is responsible for the correctness of such settings.

6. Content on behalf of another person

The user may create content on behalf of another person, company, brand, executive, employee or client only if they have lawful permission.

The user confirms that they have the right to:

  • use the name;
  • use the profile;
  • use the manner of speech;
  • use biographical information;
  • use previous publications;
  • create and publish content on behalf of such person;
  • connect the social network account belonging to them;
  • provide KONZA with the relevant materials and personal data.

It is prohibited to use KONZA for unlawful impersonation — presenting oneself as another person without their consent or authority.

7. Account

The user must:

  • provide accurate information;
  • use their own or duly authorised Google account;
  • not give access to outsiders without proper control;
  • keep their Google account secure;
  • inform KONZA of suspicious activity;
  • not create accounts to circumvent restrictions;
  • not use someone else’s account without permission.

The user is responsible for actions performed through their account, except where unauthorised access occurred through KONZA’s fault or where liability cannot be limited by law.

8. Social network integrations

KONZA may work with social networks through their official APIs.

By connecting a social network, the user:

  • grants KONZA the permissions listed on the connection page;
  • confirms that they have the right to manage the relevant account;
  • allows KONZA to perform actions within the granted permissions;
  • agrees to the rules of the relevant social network;
  • is responsible for correctly choosing the account, page and publication settings.

KONZA may depend on the availability and rules of third-party platform APIs.

A social network may:

  • change its API;
  • revoke a particular permission;
  • restrict a feature;
  • block a token;
  • reject a publication;
  • delete content;
  • restrict an account;
  • change its rules without KONZA’s involvement.

KONZA does not control such decisions and does not guarantee the permanent availability of integrations.

9. Automatic publication

If the user activates automatic publication, KONZA may transmit content to the selected social network in accordance with the user’s settings.

The user is responsible for:

  • the choice of account;
  • the date and time of publication;
  • the subject matter;
  • the content of the material;
  • the correctness of the settings;
  • having the necessary permissions;
  • compliance with the platform’s rules;
  • the consequences of publication.

KONZA does not guarantee that a publication:

  • will succeed;
  • will occur at the exact time;
  • will not be delayed because of an API;
  • will not be rejected by the platform;
  • will not be deleted;
  • will achieve a particular reach.

The user must monitor connected accounts and publication results.

10. Prohibited use

It is prohibited to use KONZA for:

  • violating the legislation of Ukraine;
  • creating or distributing unlawful content;
  • infringing copyright;
  • infringing trademark rights;
  • violating the right to privacy;
  • unlawfully using personal data;
  • impersonating another person;
  • creating false statements on behalf of another person;
  • defamation or knowingly spreading false information;
  • threats;
  • harassment;
  • bullying;
  • hate speech;
  • discrimination;
  • fraud;
  • phishing;
  • creating malicious software;
  • obtaining other people’s passwords or payment details;
  • spam;
  • mass unsolicited messages;
  • manipulative reviews;
  • fake recommendations or testimonials;
  • unlawful political campaigning;
  • manipulating voters;
  • creating misleading synthetic content;
  • creating deepfake materials without a lawful basis, consent and proper labelling;
  • circumventing technical restrictions;
  • interfering with the security of the Service;
  • obtaining unauthorised access;
  • automated extraction of data from the Service;
  • copying internal prompts, workflow or architecture;
  • creating a competing service by copying substantial elements of KONZA;
  • using the Service in a way that creates excessive load or a threat to other users.

KONZA may restrict access if it has reasonable grounds to believe that the user is violating this section.

11. AI-generated and synthetic content

The user must label AI-generated or synthetic content where this is required by:

  • legislation;
  • a social network rule;
  • an advertising policy;
  • the nature of the publication;
  • a contract with a client;
  • the right of another person;
  • another mandatory standard.

It is prohibited to use KONZA to create materials that mislead people as to:

  • the author;
  • the source;
  • a real event;
  • the authenticity of a statement;
  • the participation of a particular person;
  • the existence of permission or endorsement from another person.

12. News and third-party sources

KONZA may use news, open sources, links and other third-party materials.

KONZA:

  • is not a news editorial office;
  • does not guarantee the accuracy of every third-party source;
  • does not guarantee the completeness of information;
  • does not guarantee the absence of errors in the original source;
  • does not guarantee the correctness of automated analysis;
  • does not replace professional fact-checking.

The user must independently verify:

  • the original source;
  • the publication date;
  • the currency of the information;
  • quotes;
  • statistics;
  • context;
  • the correctness of conclusions;
  • the right to use the material.

13. No professional advice

KONZA materials are not:

  • legal advice;
  • medical advice;
  • financial advice;
  • tax advice;
  • an investment recommendation;
  • psychological counselling;
  • a professional opinion;
  • the official position of a public authority.

Content related to regulated or high-risk areas must be reviewed by an appropriate specialist.

14. User materials

User materials include:

  • texts;
  • questionnaires;
  • profiles;
  • prompts;
  • instructions;
  • files;
  • links;
  • previous publications;
  • brand materials;
  • social network data;
  • personal data;
  • other materials transferred to KONZA.

The user retains the rights to their materials.

The user grants KONZA a non-exclusive right to use such materials only to the extent necessary for:

  • operating the Service;
  • creating the output;
  • storing history;
  • operating integrations;
  • publishing at the user’s command;
  • technical support;
  • ensuring security;
  • complying with legal requirements.

The user confirms that:

  • they hold the rights to the materials;
  • they have the right to transfer them to KONZA;
  • the materials do not violate the law;
  • the materials do not infringe third-party rights;
  • the permissions granted are sufficient for the Service to operate.

15. Use of materials for model training

KONZA does not use user materials to train or fine-tune its own AI models.

KONZA does not transfer materials to OpenAI or Anthropic for the purpose of training or fine-tuning their models.

Materials may be transferred to AI providers in order to fulfil a specific request, ensure security and carry out technical operation, in accordance with the terms of the relevant provider.

16. Rights to the generated output

Subject to compliance with these Terms, the user may use the output created for them for lawful purposes.

However, KONZA does not guarantee that:

  • the output is unique;
  • the output is original in the legal sense;
  • the output is protected by copyright;
  • a similar output will not be created for another user;
  • the output contains no elements resembling known materials;
  • use of the output does not require further review.

Ideas, topics, concepts, general wording, content structure, generation methods, internal prompts, templates and workflow do not become the exclusive property of the user.

The user must check the output for:

  • plagiarism;
  • copyright;
  • trademarks;
  • rights to name and image;
  • confidential information;
  • personal data;
  • platform rules.

17. KONZA intellectual property

KONZA and its related materials, in particular:

  • program code;
  • architecture;
  • interface;
  • design;
  • name;
  • logo;
  • documentation;
  • internal prompts;
  • system instructions;
  • templates;
  • algorithms;
  • workflow;
  • automation logic;
  • settings;
  • technical solutions;

belong to individual entrepreneur Abelchakov Illia Leonidovych or are used by them on lawful grounds.

The user is granted a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms.

This right does not include the right to:

  • copy the Service;
  • sell access to the Service in their own name;
  • transfer the account;
  • decompile the software;
  • carry out reverse engineering;
  • obtain internal prompts;
  • copy the workflow;
  • create a derivative competing product;
  • extract data by automated means;
  • circumvent technical restrictions.

18. Third-party services

KONZA uses or may use:

  • OpenAI;
  • Anthropic;
  • Hetzner;
  • Google Login;
  • Google Analytics;
  • Meta Pixel;
  • social network APIs;
  • payment services;
  • other technical tools.

Third-party services operate under their own terms.

KONZA does not control:

  • their continuous operation;
  • changes to their rules;
  • changes to their APIs;
  • technical failures;
  • account blocking;
  • decisions to delete content;
  • changes to their pricing;
  • the discontinuation of a particular feature.

KONZA is not affiliated with LinkedIn, Instagram, Threads, Meta, OpenAI, Anthropic, Google or Hetzner unless expressly stated otherwise.

The use of third-party names indicates only technological compatibility or the use of the relevant service.

19. Availability and modification of the Service

KONZA evolves and may change.

We may:

  • add features;
  • remove features;
  • change the interface;
  • change limits;
  • change the supported social networks;
  • replace AI providers;
  • carry out technical maintenance;
  • temporarily restrict access;
  • discontinue outdated or unsafe features.

We do not guarantee uninterrupted or error-free operation of the Service.

Temporary unavailability may arise from:

  • technical maintenance;
  • updates;
  • server failures;
  • AI provider failures;
  • social network API failures;
  • cyberattacks;
  • outages;
  • force majeure;
  • lawful requirements of public authorities;
  • other circumstances beyond KONZA’s reasonable control.

20. Experimental features

Certain features may be labelled as:

  • beta;
  • test;
  • preview;
  • experimental;
  • early access.

Such features may:

  • work unstably;
  • contain errors;
  • change without notice;
  • produce inaccurate results;
  • be temporarily unavailable;
  • be removed.

The user must review the results of experimental features especially carefully.

21. Paid features

Some KONZA features may be paid.

Before making a payment, the user must have access to:

  • the name of the plan or service;
  • the price;
  • the currency;
  • the term of access;
  • the main limitations;
  • information about whether the payment is one-off or recurring;
  • the terms of automatic renewal, where it applies.

Payment is processed by the payment service available on the payment page.

If a subscription renews automatically, the user grants permission for repeat charges in accordance with the terms of the selected plan.

The user is responsible for:

  • the accuracy of payment details;
  • the availability of funds;
  • bank fees;
  • taxes or other charges, where they apply;
  • cancelling automatic renewal in good time.

22. Cancelling a subscription

The user may cancel future subscription renewal:

  • through the account settings, if such a feature is available;
  • through the payment provider’s interface;
  • by contacting support@konza.pro.

Cancelling a subscription stops future charges but does not in itself mean an automatic refund for a period already paid for or actually used.

Unless otherwise stated for a specific plan, access to the paid plan may remain until the end of the paid period.

23. Refunds

Refunds are made in the cases and in the manner provided for by:

  • the legislation of Ukraine;
  • the terms of the specific plan;
  • the information on the payment page;
  • these Terms.

The user may request a refund if:

  • the payment was charged twice;
  • the payment was charged in error;
  • the paid access was not provided;
  • the Service has a material discrepancy with the stated functionality that has not been remedied within a reasonable time;
  • a refund is expressly required by the legislation of Ukraine;
  • KONZA has agreed to a refund in a specific situation.

A refund is not made automatically merely because:

  • the user changed their mind;
  • the user did not use the access for personal reasons;
  • the user did not obtain the expected number of views, followers, clients or sales;
  • a social network rejected, deleted or restricted a publication;
  • the user did not review AI-generated content;
  • the user made an error in the settings;
  • the user did not cancel automatic renewal in time.

These limitations apply only to the extent that they do not conflict with mandatory consumer rights.

A refund request should be sent to:

support@konza.pro

The request must state:

  • the account email;
  • the date of payment;
  • the amount;
  • the transaction identifier, if available;
  • the reason for the request.

24. Chargebacks and payment disputes

Before applying to a bank or payment provider for a forced refund, the user should, where possible, first contact KONZA to clarify the situation.

Filing a knowingly false chargeback request may be treated as a violation of these Terms.

KONZA has the right to provide a bank or payment provider with the information needed to confirm:

  • the creation of the account;
  • the making of the payment;
  • the provision of access;
  • the use of features;
  • correspondence with the user;
  • acceptance of these Terms.

25. No guarantee of results

KONZA does not guarantee:

  • an increase in sales;
  • the acquisition of clients;
  • an increase in the number of followers;
  • an increase in reach;
  • the virality of a publication;
  • audience approval;
  • social network approval;
  • high search rankings;
  • the absence of negative reactions;
  • the uniqueness of every output;
  • that the output matches the user’s subjective expectations;
  • the uninterrupted availability of third-party services.

The result depends, in particular, on:

  • the input data;
  • the settings;
  • review by the user;
  • social network algorithms;
  • the audience;
  • the market;
  • the time of publication;
  • external factors that KONZA does not control.

26. Disclaimer of warranties

To the extent permitted by the legislation of Ukraine, KONZA is provided on an “as is” and “as available” basis.

We do not guarantee:

  • the complete absence of errors;
  • uninterrupted operation;
  • absolute security;
  • the accuracy of every AI output;
  • the compliance of every output with the law without review by the user;
  • the absence of similarity to other materials;
  • the retention of every feature;
  • the uninterrupted operation of APIs;
  • the absence of blocking decisions by social networks.

This section does not limit rights and warranties that cannot be excluded under the legislation of Ukraine.

27. Limitation of liability

To the maximum extent permitted by the legislation of Ukraine, KONZA is not liable for:

  • the user’s decision to publish content;
  • the use of content without review;
  • factual errors in AI-generated content;
  • false or outdated data in a third-party source;
  • infringement of third-party rights caused by the user’s materials;
  • the unlawful use of another person’s name, style or profile;
  • the deletion or blocking of a publication by a social network;
  • the blocking of the user’s account by a social network;
  • a decrease in reach;
  • the loss of followers;
  • loss of profit;
  • loss of business reputation;
  • lost opportunity;
  • indirect or incidental damages;
  • a failure of a third-party AI provider;
  • a failure of Hetzner;
  • a failure of Google Login;
  • a failure of a social network API;
  • incorrect automatic publication settings;
  • unauthorised access caused by the user’s inadequate protection of their account.

If KONZA’s liability is established and may be limited by contract, its aggregate amount for claims connected with the use of the Service may not exceed the amount actually paid by the user for KONZA during the last six months before the event giving rise to the claim.

If the user has made no payment, liability is limited to documented direct damages, to the extent permitted by law.

The above limitations do not apply where liability cannot be limited by law, in particular in cases of intentional violation, fraud or in other cases expressly established by law.

Mandatory consumer rights are not excluded.

28. Indemnification in connection with the user’s actions

If the user uses KONZA in business or professional activity, they undertake to compensate documented damages and expenses arising from:

  • unlawful user materials;
  • copyright infringement;
  • trademark infringement;
  • breach of privacy;
  • unlawful processing of personal data;
  • unauthorized impersonation;
  • the publication of false or unlawful content;
  • violation of social network rules;
  • violation of these Terms;
  • third-party claims caused by the user’s actions.

This section applies only to the extent permitted by the legislation of Ukraine and does not release KONZA from its own liability.

29. Moderation, checks and restriction of access

KONZA may apply automated or manual checks in order to:

  • detect abuse;
  • protect security;
  • prevent fraud;
  • control technical load;
  • comply with lawful requirements;
  • protect the rights of third parties.

KONZA may temporarily restrict or terminate access if:

  • the user violates these Terms;
  • the user has not paid for the plan;
  • the account creates a security risk;
  • there is a suspicion of fraud;
  • the use infringes the rights of third parties;
  • a lawful demand of a public authority or court has been received;
  • the user attempts to circumvent technical restrictions;
  • the user’s actions create a risk to the Service or other users;
  • a third-party provider requires a particular integration to be discontinued;
  • continuing to provide access could violate the law.

Where possible and not prohibited by law or security requirements, the user may be informed of the reason for the restriction.

30. Termination of use

The user may stop using KONZA at any time.

To delete an account, the user may contact:

support@konza.pro

Termination of use does not:

  • cancel obligations in respect of payments already made;
  • automatically delete content from social networks;
  • terminate the intellectual property provisions;
  • terminate the provisions on liability for previous violations;
  • cancel the statutory retention periods for accounting or other mandatory records.

31. Complaints about content or infringement of rights

If a person believes that content created or published through KONZA:

  • infringes copyright;
  • infringes trademark rights;
  • violates privacy;
  • unlawfully uses a name or image;
  • contains defamation;
  • infringes other rights;

they may contact:

support@konza.pro

The request must state:

  • the name of the applicant;
  • contact details;
  • a description of the infringement;
  • a link to or identifier of the material;
  • confirmation of the right or legitimate interest;
  • the desired form of response.

KONZA may request additional documents and take interim measures if the complaint appears well-founded.

32. Governing law

These Terms are governed by the legislation of Ukraine.

The relations between KONZA and the user are governed, in particular, by the provisions of the civil legislation of Ukraine and the legislation on electronic commerce, digital content and digital services, personal data protection, copyright and consumer protection — to the extent applicable to the specific legal relations.

33. Dispute resolution

The parties must first attempt to settle a dispute through negotiations.

The user may send a written claim to:

support@konza.pro

The claim must contain:

  • the user’s name;
  • the account email;
  • a description of the situation;
  • the user’s demands;
  • documents, screenshots or other evidence, if any.

If the dispute is not settled through negotiations, it is considered by the competent courts of Ukraine in accordance with the jurisdiction rules established by the legislation of Ukraine.

Nothing in these Terms limits the mandatory consumer rights to apply to a court or a public authority or to use another remedy provided by law.

34. Changes to the Terms

KONZA may change these Terms in connection with:

  • the development of the Service;
  • changes in functionality;
  • the addition of new providers;
  • changes in social network rules;
  • changes in pricing;
  • legal requirements;
  • security reasons;
  • changes in business processes.

The current version is published on the KONZA website.

Material changes may additionally be announced through the website, the account or by email.

If the user does not agree with the updated Terms, they must stop using the Service.

35. Severability

If a particular provision of these Terms is found to be unlawful, invalid or unenforceable, this does not affect the validity of the remaining provisions.

The invalid provision applies to the maximum extent permitted by law or is replaced by a provision that most closely matches its lawful purpose.

36. No waiver of rights

If KONZA does not exercise a particular right or does not respond immediately to a violation, this does not constitute a waiver of that right and does not prevent it from being exercised later.
